CHAVEZ SAYS IT'S A SAD SCENARIO SHE'S HEARD BEFORE. THAT'S WHY SHE'S COMMISSIONING THE SURVEY. SHE WANTS NEW MEXICO EMPLOYERS TO RESPOND AND ANSWER HONESTLY. ARE THEY AWARE OF THE BREASTFEEDING LAWS? ARE THEY OPERATING A BREASTFEEDING- FRIENDLY WORKPLACE? HOW MUCH SUPPORT DO THEY GIVE NURSING MOTHERS, IN TIME AND MONEY? AGAIN, CHAVEZ DOES NOT WANT TO PUNISH EMPLOYERS WHO ARE NOT IN COMPLIANCE, SHE WANTS TO HELP THEM CHANGE. AFTER ALL, SHE SAYS IT REALLY DOESN'T COST A LOT. THE TASK FORCE IS WORKING WITH THE UNIVERSITY OF NEW MEXICO ON THIS SURVEY. AGAIN, BEGINNING NEXT WEEK, THEY PLAN TO CONTACT HUMAN RESOURCE MANAGERS, C-E-Os, AND DEPARTMENT HEADS OF NEW MEXICO BUSINESSES. TO LEARN MORE ABOUT THE TASK FORCE, HEAD TO OUR WEBSITE, KOB DOT-COM.

THE HOUSE TODAY OVERWHELMINGLY PASSED A PLAN TO SHORE UP THE LOTTERY SCHOLARSHIP FUND .. A PLAN THAT IS ALMOST CERTAIN TO MAKE A LOT OF NEW MEXICO COLLEGE STUDENTS UNHAPPY. NEWS 13'S GABRIELLE BURKHART IS LIVE AT UNM TONIGHT ... GABBY. THE BILL WOULD LIKELY WITH HIGHER TUITION AND MORE STUDENTS ...THE LOTTERY SCHOLARSHIP CAN'T KEEP UP. "... RIO RANCHO) ITS BEEN A WONDERFUL THING WE COULD GROWTH IN LOTTERY TICKET SALES..." REPUBLICAN REPRESENTATIVE JASON HARPER'S BILL TO FIX THE PROGRAM PASSED THROUGH THE HOUSE TODAY 65 TO ONE. IT WOULD USE THE MONEY AVAILABLE IN THE LOTTERY FUND... AND DIVIDE IT BY THE NUMBER OF ELIGIBLE STUDENTS TO DETERMINE THE AMOUNT OF THE SCHOLARSHIP. SO IF THE FUND ONLY HAS 80-PERCENT OF WHAT IT NEEDS - EACH STUDENT WOULD ONLY HAVE 80-PERCENT OF THEIR TUITION COVERED. "."... ITS GONNA BE DIFFICULT FOR POORER FAMILIES TO COME UP WITH THE EXTRA NEW MEXICAN FAMILIES THAT ARE LIVING FROM PAYCHECK TO PAYCHECK..." STATE DIRECTOR OF THE LEAGUE OF UNITED LATIN AMERICAN CITIZENS RALPH ARELLANES SAYS THE SCHOLARSHIP MONEY SHOULD DEPEND ON FINANCIAL NEED. ADDING - EVEN WITH A PARTIAL TUITION PAYOUT - NOT EVERYONE WOULD HAVE THE SAME OPPORTUNITIES TO ATTEND COLLEGE. "... UNFORTUNATELY WE CAN'T DO THAT ANYMORE, THE STUDENTS WHO NOW HAVE A LITTLE SKIN IN THE GAME..." OUT OF NEARLY A DOZEN IDEAS... MANY PEOPLE SAY REPRESENTATIVE HARPERS BILL IS THE MOST FAIR. 4 ON YOUR SIDE UNCOVERS A BATTLE WITHIN THE AGENCY THAT PROTECTS OUR BORDER. THIS WOMAN SAYS SHE LOST HER JOB AS A BORDER PATROL AGENT BECAUSE SHE HAD A BABY, AND WANTED TO PUMP AND STORE HER BREAST MILK AT WORK. THE FEDERAL GOVERNMENT SAYS WOMEN CAN LEGALLY DO THAT. IN FACT, THE BORDER PATROL HAS A SPECIFIC PROGRAM FOR IT. BUT THE WOMAN YOU'RE ABOUT TO MEET SAYS HER BOSSES IN SOUTHERN NEW MEXICO FELL SHORT AGAIN AND AGAIN... AND FIRED HER FOR JUST TRYING TO BE A MOTHER WHILE WORKING FOR HER COUNTRY. 4 ON YOUR SIDE INVESTIGATOR RYAN LUBY BREAKS THIS BIG STORY. NOWHERE ELSE IS THE LINE SO CLEAR. WHERE TWO WORLDS HAVE MET IN NEWSWORTHY WAYS FOR DECADES. WHERE WE, AS A COUNTRY, PAY PEOPLE TO KEEP TABS ON WHO COMES, AND.. WHO GOES-- --PEOPLE LIKE SOPHIA CRUZ WHO GAVE UP HER JOB AS ASSISTANT CONTROLLER AT THE SANTA FE NEW MEXICAN, TO WORK THE FRONT LINE IN THE BORDER PATROL NEAR LORDSBURG. , OR GOING ON A 14-MILE HIKE.") BUT NOW, SOPHIA'S LIFE'S NOT THE SAME IN A DIFFERENT WAY. THIS PAST SPRING, THE AGENCY FIRED HER AFTER IT GAVE HER A CHOICE. YA SEE, SOPHIA FOUGHT WITH THE AGENCY EVER SINCE SHE GAVE BIRTH TO BABY ELENA AND RETURNED FROM MATERNITY LEAVE-- --EVER SINCE SHE ASKED TO PARTICIPATE IN THE AGENCY'S "LACTATION SUPPORT PROGRAM" --AND EVER SINCE SHE NEEDED TO WORK LIGHT DUTY, SO SHE COULD USE A BREASTPUMP, AND FOLLOW THE REGIMENTED SCHEDULE HER DOCTOR SET UP FOR HER. DOCTOR'S ADVICE, DOCTOR'S ORDERS FOR A FULL YEAR. YET SOPHIA SAYS THE AGENCY FAILED HER-- --AND BLURRED THE LINES ON ITS OWN PROGRAM, BY NOT ROUTINELY GIVING HER THE ADEQUATE SPACE AND TIME SHE NEEDED TO PUMP AND STORE HER MILK. AND EVEN THOUGH SOPHIA'S DOCTOR SAID SHE SIMPLY MUST AVOID-- --"ANY TYPE OF ALTERCATION" --"WORKING A NIGHT SHIFT" --AND "RESTRICTIVE CLOTHING, INCLUDING A PROTECTIVE VEST" FOR THAT FULL YEAR, --HER BOSS SAID "WE NEED YOU BACK ON FULL DUTY"-- --AND SAID SHE COULD "EITHER RESIGN OR RETURN TO FULL DUTY." EL PASO LABOR ATTORNEY, RAY MARTINEZ, RECENTLY FOUGHT FOR SOPHIA IN AN ARBITRATION HEARING. HE EXPECTS TO HEAR POSITIVE RESULTS SOON. BECAUSE FACT IS SOPHIA WANTS TO BE BACK ON THE FRONT LINE. AND WITH BABY NUMBER TWO ON THE WAY, SHE WANTS TO MAKE SURE HER EMPLOYER WALKS THE LINE IT SET-UP FOR NEW MOTHERS, AND SET-UP FOR ITSELF. I DIDN'T KNOW THAT, YA KNOW, HEY, WHEN YOU BECOME A BORDER PATROL AGENT, YOU CAN'T HAVE A FAMILY.'") IN EL PASO, TEXAS, RYAN LUBY, 4 ON YOUR SIDE. THE BORDER PATROL WILL NOT DISCUSS THIS CASE BECAUSE IT'S IN LITIGATION. BUT IN A STATEMENT, THE AGENCY SAYS, IN PART, THAT IT IS.... "...DEDICATED TO THE HEALTH AND WELL-BEING OF ALL OF ITS EMPLOYEES AND IS CONSTANTLY LOOKING FOR PROGRAMS AND INITIATIVES THAT POSITIVELY IMPACT THEIR WORK ENVIRONMENT. THE LACTATION SUPPORT PROGRAM IS ONE SUCH PROGRAM..." SOPHIA'S ATTORNEY EXPECTS AN ARBITRATOR TO MAKE A DECISION ON HER CASE IN THE NEXT TWO MONTHS. WE'VE LEARNED OF A NEW EFFORT THAT WILL TEST FEDERAL AND STATE BREASTFEEDING LAWS HERE IN NEW MEXICO. IN JUST DAYS, NEW MEXICO'S BREASTFEEDING TASK FORCE WILL SURVEY 20-THOUSAND PUBLIC AND PRIVATE BUSINESSES. "WE HOPE TO LEARN WHERE EMPLOYEES NEED SUPPORT, AND HOW WE CAN BETTER FILL THE GAP.

THE HOUSE HAS OVERWHELM INGLY PASSED A PLAN TO SHORE UP THE LOTTERY SCHOLARSHIP FUND.. A PLAN THAT IS ALMOST CERTAIN TO MAKE A LOT OF NEW MEXICO COLLEGE STUDENTS UNHAPPY. THE BILL WOULD LIKELY MEAN EVERY STUDENT HAS TO TAKE A HIT... MEANING THE LOTTERY WOULD NO LONGER COVER THE FULL COST OF TUITION. NEWS 13'S GABRIELLE BURKHART HAS THE STORY. WITH HIGHER TUITION AND MORE STUDENTS ...THE LOTTERY SCHOLARSHIP CAN'T KEEP UP. "...ITS BEEN A WONDERFUL THING WE COULD COVER 100 PERCENT OF TUITION, BUT UNFORTUNATELY TUITION GROWTH HAS OUTSTRIPPED GROWTH IN LOTTERY TICKET SALES..." REPUBLICAN REPRESENTATIVE JASON HARPER'S BILL TO FIX THE PROGRAM PASSED THROUGH THE HOUSE TODAY 65 TO ONE. "...ITS GONNA BE DIFFICULT FOR POORER FAMILIES TO COME UP WITH THE EXTRA MONEY, YOU KNOW A COUPLE THOUSAND DOLLARS IS A LOT OF MONEY TO A LOT OF NEW MEXICAN FAMILIES THAT ARE LIVING FROM PAYCHECK TO PAYCHECK..." STATE DIRECTOR OF THE LEAGUE OF UNITED LATIN AMERICAN CITIZENS RALPH ARELLANES SAYS THE SCHOLARSHIP MONEY SHOULD DEPEND ON FINANCIAL NEED. ADDING - EVEN WITH A PARTIAL TUITION PAYOUT - NOT EVERYONE WOULD HAVE THE SAME OPPORTUNITIES TO ATTEND COLLEGE. "...UNFORTUNATELY WE CAN'T DO THAT ANYMORE, THE FUND IS BANKRUPT - BUT I THINK THIS WILL BE A GOOD THING FOR OUR PEOPLE SAY REPRESENTATIVE HARPERS BILL IS THE MOST FAIR. AND SAY REQUIRING STUDENTS TO MAKE UP THE TUITION DIFFERENCE - COULD BE ANOTHER INCENTIVE TO GET A DEGREE ON TIME. GOVERNOR SUSANA MARTINEZ HASN'T SAID IF SHE'D SIGN THE BILL IF IT GETS THROUGH THE SENATE. BUT THE GOVERNOR DID SAY WHILE SHE APPRECIATES THAT LAWMAKERS ARE TRYING TO FIX THE LOTTERY SCHOLARSHIP... SHE BELIEVES THEY ALSO NEED TO LOOK AT CHANGES BASED ON MERIT OR FINANCIAL NEED. THE BILL ALSO CALLS FOR REDUCING THE NUMBER OF SEMESTERS STUDENTS CAN BE ON THE SCHOLARSHIP FROM EIGHT TO SEVEN.
