DEVELOPMENTS COMING OUT OF SANTA FE REGARDING SAME SEX MARRIAGE ARE IN THE HANDS OF THE NEW MEXICO SUPREME COURT. THERE WERE TENSE MOMENTS AS FIVE JUSTICES HEARD ARGUMENTS ON WHETHER SAME- SEX MARRIAGE SHOULD BE LEGAL STATEWIDE IN NEW MEXICO. LARGE CROWDS SHOWED UP IN SANTA FE YESTERDAY AS EACH SIDE WAS GIVEN ONE HOUR TO PRESENT ITS CASE TO THE HIGH COURT. THE ATTORNEY REPRESENTING SIX SAME-SEX COUPLES ARGUED BECAUSE THE MARRIAGE STATUTE IS VAGUE... IT WOULD BE DISCRIMINATION TO NOT ALLOW SAME-SEX COUPLES TO WED. ONE JUSTICE ASKED WHY THE COURT SHOULD BE DECIDING THAT AT ALL. SANDERS: WHY IS THIS A QUESTION OF CONSITUTIONALITY AS OPPOSED TO A SOCIAL POLICY ISSUE? THIS COURT IS GUARDIAN OF NM CONSTITUTION AND THE RIGHTS GUARANTEED TO ALL PEOPLE IN NEW MEXICO UNDER THAT DOCTRINE. THERE'S A GROWING MAJORITY OF PEOPLE WHO RECOGNIZE THAT IT WOULD BE MEAN-SPIRITED AND DISCRIMINATORY TO DENY SAME-SEX COUPLES THE RIGHT TO JOIN IN THE FREEDOM TO MARRY AND THIS IS AN ISSUE THAT NEEDS TO BE DECIDED BY THE COURTS AS A QUESTION OF FUNDAMENTAL RIGHTS….EVEN IF THE JUSTICES DECLARE THAT GAY MARRIAGE IS ILLEGAL, A UNM LAW PROFESSOR TELLS US THE MARRIAGE LICENSES ALREADY ISSUED WOULD STILL BE VALID, WHICH COULD LEAD TO A WHOLE NEW COURT CASE.
